July Visa Bulletin Announced

June 14, 2007

EMPLOYMENT-BASED SECOND AND THIRD PREFERENCE CATEGORIES ARE CURRENT FOR JULY

The Update:
We are very happy to relate that the July 2007 Department of State Visa Bulletin, just released yesterday, is now current for every First, Second and Third Employment-Based Category (but not for the "all other workers" category), for every country of chargeability, including India, China, Mexico and the Philippines.
What Does It Mean?
Any employee who has been affected by the visa backlog in the Employment-Based Second (EB2) or the Employment-Based Third (EB3) preference categories, will be eligible to file the final step of his or her permanent residency process (the I-485, Adjustment of Status application) starting July 1, 2007. Further, the Department of State has announced it expects all visa categories to remain current through at least August 2007. This is a positive development as it most likely means that applications for adjustment of status may be filed up to August 31, 2007.

Please reassure your foreign national employees with priority dates coming current in July, that we will begin work on the preparation of the necessary legal documents once we have communicated with you about their eligibility and received your authorization to move forward. As always, Weaver, Schlenger & Mazel will work closely with you and your employees to ensure a smooth and timely filing.
